III. THE COMPLAINT FAILS TO STATE A CLAIM

To survive a motion to dismiss, the complaint must contain sufficient factual matter, accepted as true, to "state a claim to relief that is plausible on its face." Bell Atl. Corp. v. Twombly, 550 U.S. 544, 570 (2007). Where well-pleaded facts do not permit the court to infer more than the mere possibility of misconduct, the complaint has alleged—but it has not "show[n]"—"that the pleader is entitled to relief." Ashcroft v. Iqbal, 556 U.S. 662, 679 (2009).

Plaintiff’s Opposition rests almost entirely on the now-discarded standard from Conley v. Gibson, 355 U.S. 41, 45–46 (1957), asserting that a complaint "should not be dismissed unless it appears beyond doubt that the plaintiff can prove no set of facts in support of his claim which would entitle him to relief." That standard was retired by Twombly and Iqbal, and Plaintiff’s continued reliance on it is fatal to his Opposition.
